You will learn what bill collectors can and can not do to you. For instance, if a bill collector violates your rights and you catch them they, in most cases, dismiss you of owing a balance and remove the negative mark on your credit in lieu of facing judgment against them. However, you will not know if they are violating your rights unless you are educated on these matters. You will also learn who to contact if your rights have been violated. You will learn how to stop collection calls to home and work, what to do if the credit reporting agency doesn’t respond to you in the time allotted, who to contact if somebody is trying to use your information to obtain credit, which is considered identity theft.

Things to Know About Your Credit

  1.  Remember to always send all documents and correspondence by certified mail, return receipt so you have proof that your correspondence was received.
  2. You do not have to send a copy of your letter to another person or company, such as the Attorney General's Office, even though you have indicated on your letter that you have. It's just there to force the company you are corresponding with to take you seriously.
  3. Save all return receipts from your dispute for six years.
  4. Save all correspondence from the credit reporting agencies for seven years.
  5. If at all possible tape record all conversations you have with your creditors. Do not tell them you are recording them or they will not speak with you. If the collector breaks the law you can call back and get a manager on the phone and advise him or her that you want to play back the recording before you play it back for the Attorney General's Office. After the manager listens to the tape ask to have the debt dismissed or you will play the recording for the Attorney General's Office and demand an investigation. At the very least you will get a very good settlement.
  6. In case you are getting unjust charges from your bank or you believe the bank is doing illegal things you can call the Office of the Controller. They will fight for you without charge. Their number is in your local phone book under Government Offices.
  7. If your medical insurance is not paying your claims and your medical debts are going to collection agencies, or ifyour debt is not yet in collection, contact your medical insurance and ask for a manager. Advise the manager that if this doesn't get resolved in five business days you will file a formal complaint with the DOI (Department of Insurance). The DOI governs the medical insurance agencies and they will fight for you without charge to get the problem resolved.
  8. If you have any trouble with your car insurance or homeowner's insurance and the insurance companies are trying to rip you off, contact the Insurance Commission Office. They govern the auto and homeowner's insurance agencies. They will fight for your cause absolutely free. You can locate this agency in your local phone book under Government Offices.
  9. If you feel your attorney is misrepresenting you or not completing the job you hired him/her for, contact the Bar Association. They can help you with these matters.
  10. Never close an account until the balance has been paid in full or it will cause your credit score to go down. In some cases it will go down by as much as 30 points. Fair Isaac Scoring does not know the difference between a collection account and a good account closed with a balance due.
  11. To protect yourself from identity theft you can mail a statement to the credit reporting agency stating not to grant credit unless there is proof of signature, a picture ID, and a social security number on your application. If the items are not present during application, ask them to please call you (use your best phone number). This will limit identity theft against you.
